1. Agreement to These Terms

Welcome to Uranus Fudge Factory & General Store. These Terms of Service ("Terms") govern your use of the website located at uranusgeneralstore.com (the "Site") and any purchases, accounts, rewards programs, or messaging programs offered through the Site. The Site is owned and operated by Uranus, LLC, doing business as Uranus Fudge Factory & General Store ("Uranus," "we," "us," or "our").

By accessing or using the Site, creating an account, placing an order, or opting in to our text messaging program, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order or opt in to our text messaging program. By using the Site you represent that you meet this requirement and that any information you provide is accurate and complete.

3. Accounts

You may create an account to make checkout faster, view order history, and participate in Uranus Rewards. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us right away at the contact information below if you believe your account has been accessed without authorization.

4. Products, Pricing, and Orders

We sell handmade fudge, candy, snacks, apparel, novelty gifts, and related merchandise. All prices are listed in U.S. dollars and are subject to change without notice. We make every effort to display products and prices accurately, but errors happen. If a product is listed at an incorrect price or with incorrect information, we may refuse or cancel any order placed for that product, even after your order has been confirmed and your payment method charged. If your payment has already been processed and we cancel, we will issue a refund.

Your order is an offer to purchase. We reserve the right to accept, limit, or decline any order for any reason, including suspected fraud, product availability, or errors in pricing or product information. An order is not accepted until it ships.

Most of our products are food items made in small batches. Product appearance, weight, and packaging may vary slightly. Please review our Nutritional Information page for ingredient and allergen details before ordering.

5. Payment

We accept the payment methods displayed at checkout. By submitting payment information you represent that you are authorized to use the payment method provided. You agree to pay all charges, including applicable taxes and shipping, at the prices in effect when the charges are incurred.

6. Shipping, Warm Weather, Returns, and Refunds

Shipping options, delivery estimates, and our return and refund policy are described on our Shipping & Returns page, which is incorporated into these Terms. Because we ship perishable chocolate and fudge, we strongly recommend reviewing our Warm Weather Protection page during warmer months. Risk of loss passes to you when the carrier accepts the package from us.

7. Gift Cards

Gift cards purchased on the Site are redeemable for merchandise at uranusgeneralstore.com only and are not redeemable for cash except where required by law. Gift cards are not replaceable if lost or stolen.

8. Uranus Rewards

Our rewards program is subject to the program terms displayed on the Rewards page. Points have no cash value, may not be transferred or sold, and may be adjusted or forfeited if an order is cancelled, returned, or refunded. We may modify or end the program at any time.

9. Text Messaging Program (SMS, MMS, and RCS)

Uranus Fudge Factory & General Store offers a mobile messaging program that delivers marketing and informational messages by SMS, MMS, and RCS (Rich Communication Services) to subscribers who opt in. By opting in, you agree to the following program terms.

Program description

When you provide your mobile number and opt in, you consent to receive recurring automated marketing text messages (such as promotions, new product announcements, and cart reminders) and informational text messages (such as order confirmations and shipping updates) from Uranus Fudge Factory & General Store at the number you provided, including messages sent by an autodialer or automated system. Consent to receive marketing messages is not a condition of any purchase.

Message frequency

Message frequency varies. The number of messages you receive will depend on your activity and the promotions we are running.

Message and data rates

Message and data rates may apply. Standard messaging and data charges from your wireless carrier may apply to messages you send or receive as part of this program.

How to opt out

You can cancel at any time. Text STOP to opt out in reply to any message you receive from us, or use the unsubscribe link included in a message where available. After you text STOP, we will send you one final message confirming that you have been unsubscribed, and you will no longer receive messages from our program. If you want to rejoin, sign up again through the Site or text messaging opt-in form.

Supported carriers and delivery

Our messaging program is available on most major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your carrier and network availability. If your device or carrier does not support RCS, messages will be delivered by SMS or MMS instead.

Your obligations

You represent that you are the owner or authorized user of the mobile device and phone number you provided and that you are authorized to approve any applicable charges. If you change or deactivate your mobile number, you agree to update your subscription or text STOP so that messages are not sent to a number you no longer control.

Privacy

Your mobile number and messaging opt-in status are handled as described in our Privacy Policy. We will not share your text messaging opt-in or consent with any third party for purposes unrelated to providing you with the messaging service.

10. Intellectual Property

All content on the Site, including text, graphics, logos, product names, photographs, videos, and software, is the property of Uranus or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. "Uranus Fudge Factory," "Uranus General Store," and related marks are trademarks of Uranus. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, other than for personal, non-commercial use.

11. User Content and Reviews

TO THE FULLEST EXTENT PERMITTED BY LAW, URANUS AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Uranus and its owners, employees, and agents from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Pulaski County, Missouri, and you consent to the jurisdiction of those courts.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version on this page with a new "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

19. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and any policies referenced here, are the entire agreement between you and Uranus regarding the Site.
